 Article 1: Object
– These terms and conditions apply without restrictions or reservations to all sales concluded by the Company De Jaegher SAS, from non-professional buyers (hereinafter the “Customer” or “the Buyer”), who place an order from the online shop https://de-jaegher.com(hereinafter, the “Website” as part of a distance selling system).

– Any order placed on the Website implies irrevocable adhesion to these terms and conditions, excluding any other document and / or conditions. The client declares having the capacity to conclude the present contract that is to say to have the legal majority and not to be under tutorship or curatorship.

Article 3: Products
The proposed products are those appearing on the Website https://de-jaegher.com/eshop on the day of the consultation.
The Website https://de-jaegher.com does not sell second-hand products, defective or substandard products on the market.- We draw your attention to the fact that the photographs illustrating our products may be slightly different from the reality because of the settings of Your screen and the lighting during the photo shooting.
The photographs, graphics and descriptions of the products offered for sale are only indicative and do not engage us in any way. You have the possibility to obtain additional informations by contacting by mail our Customer Service.- In any case, the photographs of the products offered in the electronic catalog of the Website are not contractual, and can not engage the responsibility of the Seller towards the buyer.

Article 4: Prices
– The prices applicable to the orders placed from the Website are those appearing on the Website when the order is being placed.

– The prices shown are in euro, all French taxes included, excluding shipping. In the event of a product delivery outside of the French territory, custom charges and formality fees are the exclusive responsibility of the Client, unless otherwise specified. The Customer undertakes to check the possibilities of importing the ordered products with regard to the territory of the country of delivery. The recipient will be obliged to pay all import or local taxes related to his order.

Article 5: Orders
– The Buyer will need to sign up by filling in the order form on the Website and follow the instructions.
– After checking their order as well as the total cost for it – ordered products, shipping cost, options – and corrected possible errors, the Buyer will give final confirmation. Such confirmation will mean the contract is signed.
– Once the contract is signed, the Seller will email the Buyer a confirmation of their order including a recap of the information specified on the order form.

Upon the registration of Your order and within a maximum of 2 (two) business days from the date of this registration, We acknowledge receipt of Your order and inform You. De Jaegher SAS is bound by the order only from the sending of this acknowledgment of receipt. De Jaegher SAS reserves the right to refuse, without liability on its part, any order concerning a User, on just cause, especially if there is a doubt or dispute over the payment of a previous order. Once the contract has been concluded, we will send you by e-mail a receipt of your order containing a summary of the information entered on the order form. An invoice for your order will be issued and will be sent to you upon receipt by us

Article 6 : Means of payment
All orders are payable in euros.You can settle your orders:

(I) by credit card via Stripe (Visa, MasterCard, American Express or Carte Bleue): the amount of your order is debited at the same time. The date of registration of the order is that of online payment.

(II) by Apple Pay: the amount of your order is then debited at the same time. The date of registration of the order is that of online payment.

The date of registration of the order is the receipt of funds on the account De Jaegher SAS.

Article 7: Delivery
7.1 General
– De Jaegher SAS delivers throughout the European Union as well as in the rest of the world. The ordered product is delivered to the address on the buyer’s order form. This address may be different from the billing address.
– Delivery in France is performed by Le Poste national declared value
– International delivery is mandatory by La Poste international declared value
– Shipping costs are the responsibility of the buyer.

The delivery time depends on the delivery address.
– Despite the care taken in the preparation of orders, it is possible that a product is missing in it, or that an error occurred during the preparation. If you notice such an error, please notify us by email to contact@de-jaegher.com within 48 hours of receipt of the order.

7.2 Delivery
Availability and shipping time:

– The immediate availability of De Jaegher SAS products is guaranteed if the word “Add to card” is indicated on the sales page of the product at the time of purchase. The shipping time of these products varies from 1 to 7 days from the date of the order. We try to process your order as quickly as possible.

Article 8: Right of withdrawal
– In accordance with the provisions of Article L.121-20 of the Consumer Code, the buyer has a period of seven (7) working days from the date of receipt of the product to exercise his right of withdrawal from of the Seller, without having to justify reasons or to pay penalties, at the end of exchange or refund.
– The Buyer will inform the Seller about their withdrawal before the above-mentioned 14-day deadline by emailing : contact@de-jaegher.com
– The products affected by such withdrawal will have to be returned by the Buyer, as soon as possible and within 14 days of withdrawal notification at the latest, to the following address:

– Should such right of withdrawal be exercised within the above-mentioned deadline and the conditions specified in this article, only the price of the returned product(s) will be refunded by the Seller.

– In compliance with article L221-28 3rd paragraph of the French consumer code, the right of withdrawal does not apply to orders for products crafted according to the Client’s specifications or clearly customised. This especially applies to special orders, outside of the options on the Website (specific size, change of colour, etc.)

– The Seller will not refund additional fees if the Client selected a more expensive delivery option than the regular delivery option offered on the Website.

– However, we will accept the exchange and refund of jewels only if all of the following conditions are met:

The product must not have been worn, used, modified, washed or altered

The product must be fully returned in its original packaging (including all accessories) along with the related invoice.

– In the event that the restitution of the product by the Buyer is due to an error from the Seller, such as a missing product in the order or any non-compliant product received – subject to the above-mentioned article 3 – or any manufacturing defect, we undertake to refund the shipping costs paid by the Buyer to return such product to us, in addition to the purchase price of the product.
The Buyer will need to report the error by emailing contact@de-jaegher.com within 48  hours of receipt of the order at the latest.
– The Buyer having exercised their right of withdrawal in compliance with the conditions of this article will be refunded within 14  days from the date the Seller is aware of such withdrawal, in the conditions specified in paragraph  2 of this article. Such refund period may however be postponed as long as the Seller has not received the returned products from the Buyer.
– The Buyer is informed and understands that no refund or exchange will be granted to any Buyer who has not exercised their right of withdrawal in compliance with the conditions of this article.

Article 10: Personal information
– Transferring information on the Feidt Paris Website is secured using currently applicable Internet protocols.
Credit card numbers are not stored on the Site https://de-jaegher.com/eshop Website but on our bank’s secure site.
The Seller undertakes not to disclose any provided information to third parties. Such information is confidential and will be used for order processing purpose only.
– In compliance with French “loi informatique et libertés” (IT and liberties law) of January 6th 1978, you have the right to access, amend and object any personal information about you. You simply need to request it online or by mail, specifying your first name, last name, address and your customer number, should you have it, to the following address: De Jaegher SAS – 37 avenue Mac Mahon 75017 Paris, France.

Article 11: Applicable law
– Terms and conditions and this contract are governed by French law.

 Article 12: Modifications and updates
– Terms and conditions are updated on a regular basis, especially in the event of possible normative changes. New terms and conditions apply from the date they are uploaded to the Website and on any order placed from said date.

– Les présentes conditions générales de vente  s’appliquent sans restrictions ni réserves à l’ensemble des ventes conclues par la Société De Jaegher SAS, auprès d’acheteurs non professionnels (Ci-après le « Client »ou « l’Acheteur »), qui passent commande à partir de la boutique en ligne https://de-jaegher.com (Ci-après, le « Site » dans le cadre d’un système de vente à distance).
– Toute commande passée sur le Site implique l’adhésion irrévocable aux présentes conditions générales de vente, à l’exclusion de tout autre document et/ou conditions. Le client déclare avoir la capacité de conclure le présent contrat c’est-à-dire d’avoir la majorité légale et ne pas être sous tutelle ou curatelle.

Le site https://de-jaegher.com/eshop ne vend pas de produits d’occasion, défectueux ou de qualité inférieure aux standards offerts sur le marché.

– Nous attirons votre attention sur le fait que les photographies illustrant nos produits peuvent s’avérer légèrement différentes de la réalité en raison des réglages de Votre écran et de l’éclairage lors des prises de vue du bijou.
Les photographies, graphismes et descriptions des produits proposés à la vente ne sont qu’indicatifs et ne nous engagent nullement. Vous avez la possibilité d’obtenir des renseignements complémentaires en contactant par mail notre Service Clients.
– En toute hypothèse, les photos de présentation des produits proposés dans le catalogue électronique du Site ne sont pas contractuelles, et ne peuvent engager la responsabilité du Vendeur à l’égard de l’acheteur.

 Article 4 : Prix
– Les prix applicables aux commandes passées à partir du Site sont ceux qui apparaissent sur le Site au moment où la commande est passée.

– Les prix sont affichés en euros toutes taxes comprises. Les taxes douanières et formalités sont à la charge exclusive du Client, sauf indication contraire. Le Client s’engage à vérifier les possibilités d’importation des produits commandés au regard du territoire du pays de livraison. Le destinataire sera dans l’obligation de payer toutes les taxes d’importation ou locales relatives à sa commande.

Article 5 : Commandes
– L’acheteur devra s’identifier en remplissant le formulaire de commande proposé par le Site et suivre les instructions données sur le Site.
– Après avoir vérifié le contenu de sa commande, ainsi que le coût total de celle-ci (produits commandés, frais d’expédition, options facultatives), et corrigé d’éventuelles erreurs, l’acheteur la confirmera définitivement à l’étape du paiement. Cette confirmation aura valeur de conclusion du contrat.
Dès l’enregistrement de Votre commande et dans un délai maximum de 2 (deux) jours ouvrés à compter de cet enregistrement, Nous accusons réception de Votre commande et Vous en informons. De Jaegher SAS n’est lié par la commande qu’à compter de l’envoi de cet accusé de réception. De Jaegher SAS se réserve le droit de refuser, sans responsabilité de sa part, toute commande concernant un Utilisateur, sur juste motif, notamment s’il existe un doute ou un litige relatif au paiement d’une commande antérieure.
Une fois le contrat conclu, nous vous transmettrons par courrier électronique, un reçu de votre commande contenant un récapitulatif des informations inscrites sur le formulaire de commande.
Une facture de votre commande sera émise et vous sera adressée à réception par nos soins.

Article 6 : Moyens de paiement
Toutes les commandes sont payables en euros.
Vous pouvez effectuer le règlement de vos commandes :
(I) par carte bancaire via Stripe (Visa, MasterCard, American Express ou Carte Bleue) : le montant de votre commande est alors débité au moment même. La date d’enregistrement de la commande est celle du paiement en ligne.
(II) par Apple pay : le montant de Votre commande est alors débité au moment même. La date d’enregistrement de la commande est celle du paiement en ligne.

Article 7 : Livraison

7.1 Généralités
– De Jaegher SAS livre dans toute l’Union Européenne ainsi que dans le reste du monde. Le produit commandé est livré à l’adresse figurant sur le bon de commande de l’acheteur. Cette adresse peut différer de l’adresse de facturation.
– La livraison en France s’effectue, à l’initiative de l’acheteur, par la poste en valeur déclarée nationale.
– La livraison à l’international s’effectue par la poste en valeur déclarée internationale
– Les frais de livraison sont à la charge de l’acheteur.
Le délai de livraison dépend de l’adresse de livraison.
– Malgré le soin apporté à la préparation des commandes, il se peut qu’un produit soit manquant dans celle-ci, ou qu’une erreur se soit produite lors de la préparation. Si vous constatez une telle erreur, veuillez nous signaler celle-ci par mail à l’adresse contact@de-jaegher.com dans un délai maximum de 48h suivant la réception de la commande.

7.2 Livraison
Disponibilité et délai d’expédition :
– La disponibilité immédiate des produits De Jaegher SAS est garantie si la mention « En Stock » est indiquée sur la page de vente du produit au moment de l’achat. Le délai d’expédition de ces produits varie de 1 à 7 jours à compter de la date de la commande. Nous nous efforçons de traiter votre commande le plus rapidement possible.

Article 8 : Droit de rétractation
– Conformément aux dispositions de l’article L.121-20 du code de la consommation, l’acheteur dispose d’un délai de sept (7) jours ouvrés à compter du jour de la réception du produit pour exercer son droit de rétractation auprès du Vendeur, sans avoir à justifier de motifs ni à payer de pénalités, à fin d’échange ou de remboursement .
– L’acheteur informera le Vendeur de son intention de se rétracter, par e-mail, avant l’expiration du délai de 14 jours prévu à l’alinéa précédent, à l’adresse suivante : contact@de-jaegher.com
– Les produits concernés par la rétractation devront être retournées par l’acheteur, dans les plus brefs délai et au plus tard dans les 14 jours suivants la notification de sa rétractation, à l’adresse suivante :

– En cas d’exercice du droit de rétractation dans le délai susvisé et dans les conditions prévues au présent article, seul le prix du ou des produits retournés seront remboursés par le vendeur.

– Conformément à l’article L221-28 3° du Code de la consommation, le droit de rétractation ne s’applique pas pour les commandes de produits confectionnés selon les spécifications du client ou nettement personnalisés. Tel est notamment le cas des commandes spéciales, en dehors des options proposées sur le site (taille spécifique, changement de couleur…)

– Le Vendeur ne remboursera pas les frais supplémentaires si le consommateur a expressément choisi un mode de livraison plus coûteux que le mode de livraison standard proposé par le Site

– Toutefois, nous n’accepterons l’échange et le remboursement des bijoux que si toutes les conditions suivantes sont remplies :

Le produit ne doit avoir été ni porté, ni usé, ni modifié, ni lavé, ni détérioré. Les articules doivent être retournées neufs, non utilisés et munis de l’étiquette « De Jaegher » intacte et attachée, dans son emballage d’origine.

– Dans le cas où la restitution du produit par l’acheteur est due à une erreur du Vendeur, telle qu’un produit manquant dans la commande ou un produit reçu non conforme (sous réserve de l’article 3 des présentes) ou un défaut de fabrication du produit, nous nous engageons à rembourser, outre le prix d’achat du produit, les frais d’expédition engagés par l’acheteur pour la réexpédition du produit à notre Société.
L’acheteur devra signaler l’erreur par mail à l’adresse contact@de-jaegher.com dans un délai maximum de 48h suivant la réception de la commande.
– L’acheteur qui aura exercé son droit de rétractation dans les conditions du présent article sera remboursé dans un délai de 14 jours à compter de la date à laquelle le Vendeur aura eu connaissance de l’exercice de son droit de rétractation, dans les conditions prévues à l’alinéa 2 du présent article. Ce délai de remboursement sera cependant différé, tant que le Vendeur n’aura pas récupéré les produits retournés par l’Acheteur.
– L’Acheteur est informé et accepte qu’aucun remboursement ni échange ne pourra intervenir au profit de l’acheteur qui n’aura pas exercé son droit de rétractation dans les conditions du présent article.

Les numéros de carte de paiement ne sont pas conservés sur le Site https://de-jaegher.com/eshop mais sur le site sécurisé de leur établissement bancaire.
Le Vendeur s’engage à ne pas divulguer à des tiers les informations communiquées. Celles-ci sont confidentielles et ne seront utilisées que pour le traitement de la commande.
– Conformément à la loi informatique et libertés du 6 janvier 1978, vous disposez d’un droit d’accès, de rectification, et d’opposition aux données personnelles vous concernant.
